MIZAN — TERMS OF USE

1. WHAT MIZAN IS

Mizan is an information, education and provider-discovery platform focused on Islamic finance in Australia.

Mizan may provide information about financial concepts, Islamic finance structures, industry practices, providers, products and services based on information obtained from providers, regulatory sources, public documents and other sources we consider relevant.

Mizan does not currently provide financial product advice, personal financial advice, legal advice, tax advice or religious rulings.

Information provided through Mizan is intended to help users understand and navigate the market. It is not intended to make a financial decision on your behalf.

2. NO PERSONAL FINANCIAL ADVICE

Information provided through Mizan is general and factual in nature unless expressly stated otherwise.

Mizan does not take into account your personal objectives, financial situation or needs for the purpose of recommending a financial product or provider.

You should not interpret provider listings, educational information, search results, verification levels, conversational responses, examples or other content as a recommendation that you acquire, dispose of or use a particular financial product or service.

You remain responsible for your financial decisions.

3. PROVIDER INFORMATION

Mizan may identify providers that advertise Islamic-finance-related products or services.

A provider appearing on Mizan does not mean that:

• Mizan recommends or endorses that provider;
• the provider is suitable for you;
• you are eligible for its products or services;
• the provider will approve an application;
• its products are currently available;
• all information concerning that provider is complete;
• Mizan has a commercial relationship with the provider; or
• Mizan has independently certified the provider or its products as Sharia compliant.

You should confirm material information directly with the relevant provider before making a financial decision.

4. VERIFICATION LEVELS

Mizan may assign verification levels or descriptions to information.

These indicate how much information Mizan has checked, not how good a provider is.

Verification is not a:

• rating;
• recommendation;
• suitability assessment;
• safety assessment;
• regulatory approval;
• guarantee;
• financial assessment; or
• Sharia certification by Mizan.

Where information cannot be verified, Mizan may identify it as unknown, incomplete, stale or requiring further verification.

5. ISLAMIC AND SHARIA INFORMATION

Mizan may report statements, certifications, fatwas, governance arrangements or other Sharia-related information published by providers or third parties.

Unless expressly stated otherwise, Mizan does not independently certify that a provider, product, transaction, contract or investment is Sharia compliant.

Different scholars, boards and users may take different views regarding Islamic-finance structures.

Users who require religious guidance should consider obtaining guidance from an appropriately qualified person of their choosing.

6. INFORMATION MAY CHANGE

Financial products, provider criteria, fees, structures, availability, regulatory status, documents and other information may change without notice.

Mizan attempts to identify when information was last checked and may provide links to supporting sources.

We do not warrant that all information is complete, current, error-free or suitable for any particular purpose.

Where Mizan identifies conflicting or uncertain information, it may withhold the relevant information or explain the uncertainty.

7. INDUSTRY INFORMATION AND EDUCATION

Mizan may explain industry terminology, commonly observed practices, publicly stated provider requirements, financial structures and other market information.

This information is educational.

Industry practices, averages, ranges and examples do not establish what a particular provider will offer you or what outcome you will receive.

8. HOW MIZAN MAKES MONEY

Mizan is a business.

Mizan intends to earn revenue through referral fees or other commercial arrangements with participating providers when users choose to proceed through Mizan.

Where Mizan has a commercial relationship with a provider, we intend to disclose that relationship.

Commercial relationships do not determine which providers are listed or their organic position in Mizan's provider-neutral results.

Mizan does not offer pay-to-rank.

At launch, where Mizan does not have paid referral relationships with listed providers, we will say so.

9. INDEPENDENT LISTINGS

Where a provider is described as an "Independent Listing", this means Mizan does not currently have a formal commercial relationship with that provider.

It does not mean that Mizan is legally, religiously or commercially independent of every person or organisation associated with the provider, nor does it constitute an endorsement.

10. THIRD-PARTY WEBSITES AND PROVIDERS

Mizan may link to third-party websites, documents and services.

Those third parties operate independently of Mizan.

To the maximum extent permitted by law, we are not responsible for third-party:

• websites;
• products;
• services;
• representations;
• availability;
• security;
• privacy practices;
• eligibility decisions;
• financial performance; or
• conduct.

A link does not constitute endorsement.

11. NO GUARANTEE OF OUTCOMES

Mizan does not guarantee:

• finance approval;
• investment performance;
• returns;
• savings;
• rates;
• fees;
• product availability;
• eligibility;
• funding timeframes;
• provider response times; or
• any particular financial outcome.

12. USER RESPONSIBILITIES

You are responsible for assessing information before relying on it and for obtaining professional advice where appropriate.

You must not use Mizan unlawfully, attempt unauthorised access, interfere with the platform, submit malicious material, scrape the service in a manner contrary to applicable law or our technical controls, or impersonate another person.

13. INTELLECTUAL PROPERTY

Unless otherwise indicated, Mizan's software, branding, original content, design and compilation of information are owned by or licensed to A E GLOBAL CAPITAL INVESTMENTS PTY LTD.

Third-party trademarks, names and materials remain the property of their respective owners.

Their appearance on Mizan does not imply sponsorship or endorsement.

14. AVAILABILITY

We may change, suspend or discontinue any part of Mizan.

We do not guarantee uninterrupted, secure or error-free availability.

15. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty, remedy or liability that cannot lawfully be excluded, restricted or modified.

Subject to those non-excludable rights, and to the maximum extent permitted by law, A E GLOBAL CAPITAL INVESTMENTS PTY LTD and its officers, employees, contractors and agents exclude liability arising from or connected with:

• reliance on information made available through Mizan;
• inaccuracies, omissions or outdated information;
• decisions made by users;
• acts or omissions of financial providers or other third parties;
• changes to products or provider criteria;
• third-party websites or services;
• interruption or unavailability of Mizan; and
• indirect or consequential loss,

to the extent such liability may lawfully be excluded.

Where liability cannot lawfully be excluded but may lawfully be limited, our liability is limited to the maximum extent permitted by applicable law.

Australian consumer guarantees and other statutory rights that cannot legally be excluded remain unaffected.

16. ACCURACY AND MISLEADING INFORMATION

Mizan aims to communicate financial information clearly and accurately.

However, verification reflects the sources and information available at the relevant time and does not guarantee continuing accuracy.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The current version will be published on mizan.au with its effective date.

18. GOVERNING LAW

These Terms are governed by the laws applicable in Victoria, Australia, and applicable Commonwealth laws.

Nothing in these Terms limits rights you may have under mandatory Australian law.

20. Optional accounts and saved content

Mizan can be used without an account. An optional account allows you to save providers and educational resources and manage basic preferences. Saving an item is a bookmark, not a recommendation, endorsement or assessment of suitability. Saved items do not change the provider-neutral directory or its ordering.

You must provide an email address you control, verify it when requested and keep your credentials confidential. Use a unique password and contact info@mizan.au if you suspect unauthorised access. You must not use an account to impersonate another person, access another user’s data, evade security controls or misuse the service.

We may reasonably restrict, suspend or terminate an account where necessary to investigate misuse, protect users or the service, meet legal obligations or respond to a material breach of these Terms. Where appropriate and practicable, we will provide notice.

You can remove saved items and request account deletion from your account settings or by contacting info@mizan.au. Requests require review and are not an assurance of immediate deletion. We aim to respond within 30 days. We may need to retain limited information for legal, security or dispute purposes, as described in the Privacy Policy.

Accounts do not automatically save conversations or create a financial profile. Conversation saving is not available in V1. A future conversation-saving feature would require a deliberate user action and an explanation of what is saved. All existing no-advice, information, Sharia, third-party, commercial transparency and liability provisions continue to apply.
